Agreement between Legumex and CEADEL

AGREEMENTS REACHED ON SUNDAY, MARCH 18 IN THE MEETING HELD AT THE OFFICES OF CEADEL LOCATED AT 1ST AVENUE 4-76, ZONE 4 OF CHIMALTENANGO BETWEEN THE GENERAL MANAGER OF THE LEGUMEX SA COMPANY, MR. MANUEL RAMILA AND THE REPRESENTATIVES OF CEADEL, GLADIS MARROQUIN AND GABRIEL ZELADA ORTIZ.

AGREEMENTS & COMMITMENTS:

All those who are employed working in the preparation, selection and production cutting area will have the following benefits:

  • They will be remunerated according to the cutting &/or selection of product that is being prepared.  Its unit value will vary according to the type of product, but in all cases its average value should be equal to or greater than the current minimum wage.  (This will be watched during the rest of the current agricultural season (2006-2007) with the objective of observing the real increase in wages and its relation to the minimum wage.)  
  • They will have the right to the Q250.00 monthly bonus as per decree 27-2001, calculated based upon days worked, plus the 14th month bonus, aguinaldo and vacation.
  • If these workers are fired they will have the right to their non-renounceable benefits plus severance for time worked.
  • If these persons take the decision to resign from their work, they will have the right to their non-renounceable benefits.
  • They will have the right to enjoy the services of Social Security after four months service at the Legumex SA company, which is as per the order of the Guatemalan Social Security Institute (IGSS), and by the completion of the first year of employment that institution's ID card will be issued.

Those persons who are minors between the ages of 14 and 18 years of age will work seven hours a day as the Labor Code establishes.

Those who work in the administrative area, reception of raw materials, processing, packing and shipping are permanent positions and will have the following benefits:

  • They will have the right to the established minimum wage.
  • Monthly bonus, proportional to hours and days worked, of Q250 according to decree 37-2001.
  • Bonus 14 [14th month] and aguinaldo [Christmas bonus], vacations and severance in the case that they are fired.
  • Enjoy the services of the Guatemalan Social Security Institute.

The 23 minors who were fired will receive economic compensation related to time worked.  In addition they will be supported with a year of education in the Minstry's Accelerated Primary program.

All personnel who work in the areas of preparation, processing, when they work with fruit will be provided with rubber boots for the protection of their feet.

All persons who work in the Preparation area will be provided with a vest to protect them from the cold, should there be any, since they are  not permitted to use sweaters because the loose fibers can contaminate the product.

All persons who are in the processing area and working at night will be given a vest to protect them from cold.

The company will open a medical clinic which will be staffed by a physician who will attend once a week.

All those persons who work in the preparation, selection or cutting of fruits will use gloves and these will be exchanged every week or 10 days, or immediately when they are damaged.

CEADEL will be able to enter the Legumex SA company installation when it so desires.  In order to do so, each time and during this season, it will be coordinated with the General Management.  Once the visit has been carried out, [CEADEL] will leave its observations and/or written commentaries regarding the issues in question.  For the next (2007-2008) agricultural season Legumex SA will invite CEADEL to visit their installations so that they can verify the labor conditions of the workers.

CEADEL can cooperate in the training of Legumex SA personnel in labor issues and Human Relations when Legumex requests it.

CEADEL will issue information regarding the advances achieved at Legumex SA both nationally and internationally for the purpose of promoting companies which comply satisfactorily with Guatemala's labor laws.

CEADEL will analyze and interview the 23 minors who were fired as well as their parents for the purpose of determining their educational needs, and will incorporate these persons' parents into parents' schools.  For this purpose, Legumex will give CEADEL the list with names and places where these persons are from.

Beginning in July, Legumex will contract a teacher to provide accelerated primary education to the workers who wish to conclude their studies at that level.

The accelerated primary education of the 23 minors will be provided in the CEADEL offices with the support of at teacher contracted by Legumex, who among his or her responsibilities will have the education of the group of minors and the support and orientation of the parents through the parents school.

The technical training will be provided by CEADEL during a period of two years.
