Just Garments Background and Worker Documents

 

Just Garments had just 15 workers when it closed on April 2, 2007

 

 

The Just Garments factory averaged about sixty workers until December 2006, when many workers left because they were not being paid. In January 2007, 40 workers remained. In February and March, several workers were fired for complaining that their wages were not being paid, while others quit. There were just 15 workers remaining when Just Garments shut down on April 2, 2007.

To date, 19 Just Garments workers have appealed to the Jesuit University, UCA's Human Rights Institute (IDHUCA) or to the Las Dignas women's organization for help in winning back pay and benefits legally due them.

Social Security Record: Just Garments reported her as working there during 2 months (though she actually worked there 8 ½ months). Just Garments reported her average wage as $128.25 per month, $22.94 below the minimum.

Social Security Record: While she actually worked 6 ½ months, Just Garments only reported her as working 3 months....but failed to pay her Social Security dues for those 3 months.

Also, during those 3 months, Just Garments reported her earnings as $143.90 a month--$7.30 below the minimum wage.

In a October 18, 2005 letter to the Social Security Institute, Ms. Carbajal asks for certification of her SS payments between August 2004 & September 2005 and investigation of Just Garments payments to Social Security on behalf of other workers since there "exists a concern that Just Garments is evading its duty to remit its workers Social Security dues...."

 

Social Security Record: Just Garments records her as having worked from October 2004 to Aug 2005. So she actually worked during 14 months. Just Garments reports her as working during 11 months—but fails to pay her Social Security fees during 8 of those 10 months.

 

December 21, 2005 Labor Court calls Mr. Carbajal and Just Garments through its legal representative Gilberto Garcia to appear Feb 9, 2006 to attempt conciliation.

 

Feb 9, 2006 Court document—hearing did not take place because Just Garments/G Garcia failed to appear.

November 15, 2005 Court document ordering Gilberto Garcia/Just Garments to appear on December 6, 2005 for conciliation meeting re her severance pay claim.

 

December 21, 2005 Court document declaring Just Garments in contempt of court (Rebelde) for failure to appear or answer suit.

 

Social Security record: While Ms. Portillo worked at Just Garments beginning in November 2004, Just Garments reported her as a worker only beginning in January 2005. Just Garments paid her Social Security fees in February, March and April 2005, but not in November-December 2004, nor May through September 2005—failing to pay 7 of the 11 months for which they deducted Social Security payments from her wages.
